Void where prohibited or restricted by law.</p> <p><b>HOW TO ENTER:</b> Entry into the Sweepstakes will be made optional to eligible individuals who purchase a product from DKNY through/on the website www.DKNY.com (purchases from sources other than the website do not qualify for automatic entry) during the Sweepstakes entry period. Individuals who are not eligible or who do not wish to enter the Sweepstakes will be given the option not to enter. Each purchase transaction (whether comprised of a single product or multiple products) shall constitute a separate entry. You may also enter without making any purchase by simply registering online at www.DKNY.com/sweepstakes/sweepstakes.php and providing the requested information. No other methods of entry are accepted. You may enter the Sweepstakes up to, but no more than, twenty times. All entries become the property of Sponsor and will not be acknowledged. </p> <p><b>ENTRY PERIOD & DEADLINE:</b> The Sweepstakes entry period begins on May 2, 2008 at 12:01:00 a.m. Eastern Standard Time ("EST") and your purchase must be made or entry must be submitted no earlier than that date and received by Sponsor no later than 11:59:59 p.m. on the last day of the Sweepstakes, May 11, 2008, in order to be entered and eligible to win (the "entry period"). Sponsor is not responsible for failure of telecommunications equipment, the Internet, electrical power or any other interruption or interference of Internet service which prevents receipt of an entry. </p> <p><b>PRIZES & CONSUMER DISCLOSURE:</b> DETAILS AND QUALIFICATIONS FOR PARTICIPATION IN THIS PROMOTION MAY APPLY. Only one Prize may be awarded per person per household. Ten winners will be chosen. The Prize consists of one copy of the book "Mother Nurture" autographed by its author, Stephanie Hirsch. Sponsor will mail the Prize to each winner via overnight mail upon receipt of an Affidavit of Eligibility and a Liability/Publicity Release as provided herein. </p> <p>Sponsor reserves the right to substitute for the Prize a prize award of equal or greater value. The Prize, and any part thereof, has no cash equivalent and the Prize cannot be redeemed for cash or any other consideration except as explicitly set forth in these Official Rules. Sponsor is not, and shall not be, responsible if the winners are unable to accept or use all or any portion of the Prize due to the winners' failure to qualify or comply with these Official Rules or any law, regulation or other rules which apply to their acceptance, receipt and/or use of the Prize award, or for any other reason. </p> <p>If the Prize winners fail to comply with these Official Rules in any way, the Prize winners may be disqualified and the Prize forfeited. The Prize may not be transferred, substituted or exchanged, nor cash equivalent allowed. </p> <p><b>LIMITATION OF LIABILITY:</b> The Released Parties (as defined below) are not responsible for the inability of winners to accept the Prize for any reason, nor for any delivery or travel cancellations, delays, defects, damages or interruptions. The Released Parties will not replace any stolen or lost Prize. </p> <p><b>DISCLAIMER & RELEASE:</b> By participating in the Sweepstakes, each entrant (i) assumes all liability for any damages, losses or injury sustained, incurred, caused or claimed to be caused by or to winners or any third party as a direct or indirect result of participation in the Sweepstakes and/or the acceptance, awarding, receipt, use and/or misuse of the Prize, and (ii) releases and agrees to hold Sponsor, The Donna Karan Company LLC, and each of their respective officers, directors, affiliates, clients, employees and agents (together, the "Released Parties") harmless from and against any and all liability, claims or causes of action arising out of participation in the Sweepstakes and/or the acceptance, awarding, receipt, use and/or misuse of all or any portion of the Prize. The Prize winners who accept all or any portion of a Prize award in connection with this Sweepstakes grant permission to the Sponsor to use and publish his/her name, entry submission, photographs, images and likeness, opinions, place of residency, voices, biographical and other information or identification for promotional and publicity purposes, in any form and in any medium, now known or hereafter invented, without further compensation or consideration. Sponsor may also arrange to publicize any or all of the Prize winners' activities related to the Prize, and the Prize winners, and the Prize winners hereby consent and grant permission to Sponsor to permit any public relations firm, advertising agency, news or other information gathering agency or institution to be present, observe, make a record of and use and publish such activities. </p> <p>The Released Parties are not responsible for typographical, printing or other errors in the offer or administration of this Sweepstakes, including but not limited to errors in advertising, the Official Rules, the selection, notification and announcement of the winners or the distribution of the Prize, nor are they responsible for any incorrect or inaccurate information, whether caused by web site users or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error which may occur in the processing of submissions in the Sweepstakes. The Released Parties are not responsible for failed, partial or garbled telephone or computer transmissions, or for technical failures of any kind, including but not limited to electronic malfunction or damage of any network, hardware or software. If for any reason the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or other causes beyond Sponsor's control that corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes. No responsibility is assumed for: any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries; or any problems or technical malfunctions of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any email or electronic entry to be received on account of technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, including any injury or damage to entrant's or any other person's computer related to or resulting from participation in or downloading any materials from this Sweepstakes.</p> <p>If for any reason the Sweepstakes is not capable of running as planned due to earthquake, flood, fire, storm or other natural disaster, act of God, labor controversy or threat thereof, civil disturbance or commotion, disruption of the public markets, act of terrorism, war or armed conflict (whether or not officially declared), Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes without obligation or prior notice and in such event to determine the winners via random drawing from among all valid entries received up to the time of such cancellation, termination, modification or suspension. </p> <p><b>CONDUCT: CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY ALTER OR DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW. </b> <br/><b>WINNER SELECTION & NOTIFICATION:</b> Drawing for the Prize award will be conducted on the next business day (Monday-Friday) following the end of the Sweepstakes, May 12, 2008, at Sponsor's main offices. Each entrant must comply with all terms and conditions set forth in these Official Rules, and winning and the award of any prize is contingent upon fulfilling all Sweepstakes' rules and requirements. The names of the winners who are selected shall appear on the website http://www.DKNY.com/sweepstakes/winner.php no later than 3:00 p.m., EST, on the business day (Monday-Friday) following the end of the Sweepstakes. If the winners happen to be selected on Friday, Saturday or Sunday, the winners will be announced on the next business day being Monday. Winners will be contacted via telephone by Sponsor on day of winner selection.</p> <p>In order to claim the Prize and be declared an official winner, each winner will also be required to sign and return an Affidavit of Eligibility and a Liability/Publicity Release within five days after said documents are provided to winners, or the Prize will be irrevocably forfeited and an alternate Prize winner will be selected. Once all the required documentation is returned duly signed, as required, by each winner, the Prize will be awarded as set forth herein. Sponsor's decisions regarding the administration of the Sweepstakes, eligibility of entrants and selection of winners will be final and binding in all respects. </p> <p><b>NAMES OF WINNERS:</b> After the Prize is conclusively awarded to the winners, and continuing until May 30, 2008, you may obtain the winners' names by visiting the DKNY web site at http://www.DKNY.com/sweepstakes/winner.php. </p> <p><b>GENERAL CONDITIONS:</b> Failure to comply with these Official Rules may result in disqualification from this Sweepstakes. Sponsor reserves the right to disqualify from the Sweepstakes any person that Sponsor in good faith believes has intentionally violated or attempts to intentionally violate these Official Rules, any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or behaving in an unsportsmanlike or disruptive manner, at any time. Sponsor reserves the right to withdraw, cancel or modify the Sweepstakes if fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity of the Sweepstakes, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the Prize at random from among the eligible entries received up to the time of the impairment. Any attempt by any person to deliberately damage any web site or undermine the proper and legitimate operation of the Sweepstakes may be in violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any provision of these Official Rules shall not constitute a waiver of that provision. </p> <p><b>DISPUTES: </b> By entering this Sweepstakes, participating therein and/or accepting any prize, each entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prizes awarded, other than the administration of the Sweepstakes or the determination of winners, which is in the sole and exclusive discretion of Sponsor (and shall not be the subject of any dispute), shall be resolved with you individually, without resort to any form of class action, and exclusively by the state or federal courts located in the State of New Jersey; (2) any and all claims, judgments and awards against Sponsor and in your favor shall be limited to actual out-of-pocket costs incurred by you, including costs associated with entering this Sweepstakes, but in no event shall include attorneys' fees; and (3) under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim punitive, incidental and consequential damages and any other damages, including any or all rights to have damages multiplied or otherwise increased, other than for actual out-of-pocket expenses.
